United Public Workers filed a class grievance regarding dual post work assignments on behalf of DCR Corrections members in BU10. The union grieved Tommy Johnson’s February 6, 2024, decision to unilaterally stop payments for dual post work assignments. A hearing took place, and Arbitrator Tom Cestare issued his award yesterday, January 27, 2025.
The award marks a major victory for you and the union. In summary, Arbitrator Cestare ordered Johnson to reverse his decision and directed DCR to make whole all ACOs in every correctional center and facility in Hawaii. To clarify, ACOs who worked dual post assignments will receive backpay for the loss of 4 hours of pay for assignments starting February 6, 2024.
In addition to the amount owed to you, the Arbitrator instructed DCR to pay you an additional 10% interest on that sum. All payments must be made within 60 days following the decision. You are entitled to payment if you performed dual duties from February 6, 2024, to January 27, 2025. To ensure you receive your payment, please submit your claim promptly to ensure you are paid.
If you want more information, don’t hesitate to get in touch with your Union Representative by calling the local office or visiting our website at upwhawaii.org. The full arbitration decision will be posted on all facility bulletin boards within the next five working days. To our knowledge, DCR has not challenged nor appealed the award at this time. If they do so, you will be notified.
